ARTICLE 1 – Organizing Company
Manufacture Française des Pneumatiques Michelin, a partnership limited by shares with capital of €504,000,004, the registered office of which is situated Place des Carmes Déchaux in Clermont-Ferrand (F-63040) (hereinafter referred to as “the Organizer” and/or “Michelin”), registered at the Trade and Companies Register of the said town under No. 855 200 507 RCS Clermont-Ferrand, is organizing a game (hereinafter referred to as “the Game”) from September 29, 2016 at 10:00 to November 5, 2016 at 11:59 inclusive, on the forum https:/en.forum.michelinmotorsport.com. Participation in the game is completely free and with no obligation to purchase.
ARTICLE 2 – ACCEPTANCE OF THESE RULES
Participation in the Game implies full and entire acceptance by the participants of these rules and all of their provisions, as well as of the laws and regulations in force applicable to free games.
ARTICLE 3 – ANNOUNCEMENT OF THE GAME
The Game is announced on:

ARTICLE 4 – TERMS AND CONDITIONS OF PARTICIPATION
Any natural person of age in his or her country and with access to an Internet connection may participate in the Game. Each Participant is responsible for verifying that his or her country authorizes participation in the Game.
People who do not meet the above terms and conditions may not participate in the Game, nor may:
- Members of the Organizer’s management or staff who collaborated directly or indirectly in the Game;
- Natural persons or legal entities who collaborated directly or indirectly in designing, organizing or managing the Game;
- The members of their respective families (“family” means people living under the same roof and their direct and/or indirect and/or collateral ascendants and descendants);
The Organizer reserves the right to carry out any checks necessary to ensure compliance with this article or the rules as a whole, and more specifically to eliminate underage Participants or any Participant engaged in misconduct or attempted fraud. The Organizer shall not be under any obligation to systematically check all entries in the Game, but may, if appropriate, confine itself to checking the potential winners.
A natural person may not participate in the Game using a third person’s account, i.e. on behalf of another person. Proven attempts to participate fraudulently or cheat, including by creating false identities in order to register several times, may be penalized by the Participant being formally and definitively banned from receiving any prizes or being declared winner.
Participants who infringe any of the terms and conditions set out in this article shall be automatically disqualified.
Any entry that is incomplete, illegible and/or has an inaccurate address will be deemed inadmissible.
The Organizer reserves the right to disqualify a player who posts comments and/or messages that:
- incite discrimination, hostility or violence of a racist, xenophobic, sexist, homophobic or revisionist nature;
- are defamatory or disparaging;
- encourage smoking, excessive alcohol consumption or the consumption of illicit substances;
- incite others to commit crimes and/or offenses, suicide or the consumption and sale of illicit substances;
- are off-topic, such as comments of a political or religious nature;
- are pornographic (including images of nudity), pedophiliac or violent;
- may be considered spam.
ARTICLE 5 – ACCESS TO THE GAME
The Game is open from September 29, 2016 at 10:00 to November 5, 2016 at 11:59 inclusive (as evidenced by the French date and time of connection), exclusively on the forum at the following address:
During this period, the Game is accessible 24 hours a day every day, except during scheduled or unscheduled interruptions for maintenance or other reasons, and more specifically to update the databases or the hosting servers.
ARTICLE 6 – TERMS AND CONDITIONS OF PARTICIPATION IN THE GAME
To enter the Game, each participant should visit https://en.forum.michelinmotorsport.com and register by clicking the “Register” tab.
By clicking on “Register” and registering for the forum, users agree to the Game rules.
A participant may only win once throughout the duration of the game.
Access to the game is limited to one participation per person (same surname, same first name, same postal address), regardless of the number of email addresses or Facebook accounts the person owns. In the event of multiple participations during any one session, even using several different email addresses, the participant will be definitively barred from the game and will forfeit any winnings.
In any event, only one prize will be awarded per winner (same surname, same postal address).
ARTICLE 7 – CONDITIONS FOR AWARDING PRIZES
An electronic prize draw will be organized to pick the winners from among all of the entrants registered on the forum during that period.
The prize draw to select the five winners will be held on Monday November 7, 2016.
ARTICLE 8 – LIST OF PRIZES
Five Michelin Motorsport packs containing a cap, a key ring, a backpack and a portable battery, with a unit value of €32 (incl. tax).
The Organizer reserves the right to check the conditions of participation of any winner before awarding the prize.
The prizes cannot be awarded in any form other than that stipulated in these regulations. No other prize or cash shall be awarded in exchange for the prizes won. However, the Organizer reserves the right to replace the prizes by other prizes of the same value and similar characteristics should circumstances so require, and shall not be held liable on this account.
ARTICLE 9 – PRIZE PRESENTATION
Winners will be notified individually by email.
Instructions for claiming the prizes will be given in the email. If the winner or winners do not reply within four days, or if the contact details are incorrect, incomplete, illegible, forged or set out in a way that infringes these regulations, the prize will not be awarded to a runner-up.
Similarly, if the winners decline the prizes, the latter will not be awarded to the runners-up.
ARTICLE 10 – LIABILITY IN THE EVENT OF FORCE MAJEURE / GAME EXTENSION SAFEGUARD CLAUSE
Michelin shall not be held liable if, in the event of force majeure or circumstances beyond its control, this Game had to be modified, extended, curtailed or canceled, especially if the Game gave rise to unforeseen cases of cheating and/or misuse of any kind. The Organizer reserves the faculty to end the Game without designating a winner and to use the prizes for a future operation.
In any case, it reserves the possibility of extending, modifying, shortening or canceling the Game and postponing any date announced.
The Organizer shall not be held liable in the event that one of the winners cannot be contacted by email for reasons beyond its control (including technical problems with the internet service provider, the telecom operator or in the event that an incorrect email address was supplied).
In these cases, winners may not claim any compensation whatsoever.
Michelin shall not be held liable in the event that one or more participants could not log onto the internet site or play the Game because of a technical fault or any problem caused by congestion on the internet network. In particular, Michelin shall not be held liable for any tangible or intangible damage caused to participants’ computer equipment or the data stored on it, or the consequences on their personal, professional or commercial activity.
The following is a non-exhaustive list of cases deemed to be force majeure: natural disasters, floods, strikes, interruption in the connection to the internet service provider, technical breakdowns, electricity outages, connection problems, line breakages, data losses or other events that may affect, defer, slow or prevent access to the Game website. The Organizer undertakes to do everything possible to put an end to these situations as soon as possible. Participants shall not be entitled to hold the Organizer liable or apply for compensation of any sort as a result of the changes or cancellations that may have been made.
ARTICLE 11 – PROTECTION OF PERSONAL DATA
The personal data you may be required to disclose to Michelin for the Company to send you your prize is limited to your surname, first name, email address and postal address. Only Michelin staff and the service provider Michelin uses, if any, may use this data. The data is retained for the time necessary to manage the game, and at most for 6 months, after which it will be destroyed.
Under the amended French Data Protection Act (Loi Informatique et Libertés du 6 janvier 1978 modifiée), Participants in this Game have the right to access, rectify, object to the use of and delete their personal data. ARTICLE 12 – LITERARY AND ARTISTIC COPYRIGHT
Under the laws on literary, artistic and industrial copyright in France, the reproduction, representation or use of all or part of the components of the Game are strictly prohibited. The brands quoted in the Game are registered trademarks of their respective owners.
ARTICLE 13 – REIMBURSEMENT
Participants may have the postage costs incurred in requesting the Game rules reimbursed to them (at the current non-priority rate). To do so, they should send a written request to the Organizer’s address, enclosing the details of their bank, savings bank or post office account.
Participants may also request the reimbursement of the internet connection costs incurred for participating in the Game for up to six minutes and excluding mobile connection costs. To do so, they should send a written request to the Organizer’s address, including the following information, set out legibly: surname, first name, full postal address, date and time of participation. The reimbursement request should be accompanied by details of the participant’s bank, savings bank or post office account and a copy of the participant’s internet service provider’s bill showing: the precise nature of the internet service provider’s service and its charging system (unlimited, flat rate, etc.) and the date and time of connection corresponding to the participation in the Game, clearly underlined or highlighted by the Participant. Given that, in the current state of service offerings and technology, some internet service providers offer online users a free or flat-rate connection, it is expressly agreed that any access to the website that is free of charge or charged at a flat rate (such as cable, ADSL or specialized links) shall not be reimbursed. The subscription to the internet service provider’s services is taken out by the online user for his internet usage in general and the fact that the participant logs onto the website and participates in the Game does not incur any additional costs or expenses for him. The costs of photocopying any documentary proof that has to be furnished shall be reimbursed at the rate of 0.15 euro (including tax) per sheet.
The reimbursement shall be made by check or by bank transfer, or by any other medium chosen by the Organizer.
ARTICLE 14 – COPY OF THESE RULES
Participants may obtain a copy of these rules on request to the Organizing Company specified in Article 1, throughout the duration of the Game.
The full rules may be read, downloaded and printed out, free of charge, at the forum’s address throughout the duration of the Game.
ARTICLE 15 – APPLICABLE LAW
The Game and these rules are governed by French law.
In the event of a contradiction between the original French version and its subsequent translations into various other languages, the French version shall prevail.
Any contentious interpretation of these rules and any cases not covered shall be settled by a jury appointed by the Organizer. Any requests concerning the interpretation of these rules should be submitted in writing. Any request concerning the interpretation of these rules that is received by the Organizer more than fifteen (15) days after the end of the Game shall not be answered.
Any difficulty of interpretation and any contentious cases shall be settled without appeal by the Courts of Clermont-Ferrand (France) in accordance with French law.
